This Agreement governs the submissions of designs, slogans, pictures, artwork, or other materials (hereafter, “Submission” or “Submissions”) to ShirtCraze.com. This document, whether in paper or electronic form, constitutes a binding contract between the submitter (“Submitter” or “You”) and ShirtCraze.Com, and may not be modified except in a writing signed by an authorized agent of ShirtCraze.com.

By clicking below, and by submitting any Submission to ShirtCraze.Com, You hereby represent that (a) You have the capacity to enter into a contract, (b) that You are over eighteen (18) years of age, (c) that You are a resident of the United States of America, and (d) that You indicate Your assent to this Agreement and Your intent to be legally bound by the terms hereof.

For and in consideration of the review of Your Submissions, and for and in consideration of Your entry into the Contest, as set forth below, and for other good and valuable consideration, the receipt of which is hereby acknowledged, You hereby agree as follows:

By submitting any Submission to ShirtCraze.com, You hereby represent that You are the sole author and/or rights holder in such Submission, that such Submission is your own original work, has not been previously published, and does not contain any trademark, logo, copyrighted material, or any other intellectual property of any kind which may belong to any third-party, or that may infringe upon any rights of any third-parties. By transmitting the Submission to ShirtCraze.com, You agree to assign all right, title, and interest in the Submissions (including, without limitation, all copyright, trademark, trade dress, contract, moral or other rights, and regardless of whether such rights are federal or state, and whether such rights are codified or at common law) to ShirtCraze.com, as well as to grant ShirtCraze.com a fully paid-up, exclusive, transferable, irrevocable and unlimited license in all intellectual property comprising the Submission.   All Submissions become the sole property of ShirtCraze.Com, and will not be returned to You.   You agree that You will not use or commercially exploit the Submission for any purpose following its tender to ShirtCraze.Com, without the express prior written permission of ShirtCraze.Com.

We may, at our sole discretion, and without any obligation or further compensation to You, register a copyright in, trademark, and/or commercially exploit any Submission.  In the event that ShirtCraze.Com submits a registration to any officiating body which oversees intellectual property registrations, ShirtCraze.Com will identify you as the author of the Submission.  Further, upon request, You agree to provide sufficient and accurate identifying information to allow ShirtCraze.Com to complete any such registration.

You are tendering the Submission to be entered in a design contest (“Contest”).  No purchase is necessary to enter the Contest, but no entry to the Contest will be accepted without a Submission.  Upon receipt of Submissions, ShirtCraze.Com will evaluate the Submission for compliance with its design criteria, which include the following:

• No Submission will be accepted which, in the sole opinion of ShirtCraze.Com, is obscene, defamatory, promotes illegal activity, or is otherwise offensive.
• If a Submission contains language, the Submission will not be accepted unless it is in English, or is amenable to ready translation, and free of obscenity in any language.
• ShirtCraze.Com reserves the right to refuse entry to the Contest of any Submission for any reason, in its sole discretion.

The refusal of ShirtCraze.Com to accept any Submission for entry into the Contest does not affect the assignment of rights in the Submission set forth above.

Once a Submission is accepted, the Submission will be place on the Website for voting. Voting is open to the public, and one vote per IP address, per entry, per day can/will be recorded. You may link to the voting page for Your Submission on other websites, provided that no “hotlinking” is employed, that the full link is utilized, that third parties are directed only to ShirtCraze.Com’s website, and the entire page (with all Terms of Use and copyright notices intact) is viewable by parties directed to such link. You agree not to engage, directly or indirectly, in any attempt to defraud or otherwise unduly influence the voting process, and You further agree not to employ, directly or indirectly any virus, Trojan, “bot”, dialer, script, robot, or other means of inflating vote counts or engaging in machine-assisted entries.   ShirtCraze.Com reserves the right, in its sole discretion, to withdraw or invalidate any Submissions, votes cast, or voting results.  The judgment of ShirtCraze.Com as to the outcome of all voting shall be final.

Submissions shall be accepted from the 1st of the month through the 24th of the month for the next month’s voting.  Voting for each month's submissions shall run from the 1st of the month to the 24th of that month, unless otherwise posted.  Winners will be notified within 2 business days of the close of voting, using the contact information provided by You upon Submission.  ShirtCraze.com is not responsible for inaccurate contact information, and does not verify personal information when submitted.

Winners, in order to receive prizes, must promptly submit high-resolution artwork satisfactory to ShirtCraze.com, according to the technical specifications provided.  Failure to submit acceptable high-resolution artwork in a timely manner will disqualify winner from receipt of prizes.  Prizes will be sent within four (4) to six (6) weeks from the acceptance by ShirtCraze.com of submitted high resolution artwork from the winner.  Winners shall be solely responsible for all applicable taxes on any prizes. 

Participation in the Contest is void where prohibited, and is subject to applicable law.  Winners of the Contest shall be determined solely by voting on the website, with the Submission gathering the most votes being awarded the prize(s) set forth in such Contest.

Prizes are subject to change from time to time, without notice. All prize awards are at the sole discretion of ShirtCraze.com, whose decisions shall be final and binding upon all entrants.
